Sam Houston Electric Cooperative complies with the requirements of the Federal Energy Regulatory Commission’s Order No. 717, which establishes requirements for the separation of transmission functions and marketing functions. Sam Houston EC has posted the following information in compliance with Order No. 717.

Employee-Staffed Shared Facilities

Pursuant to 18 C.F.R. § 358.7(e)(2), Sam Houston Electric Cooperative is required to post the location of employee-staffed facilities shared by Transmission Function and Marketing Function Employees.

As of May 29, 2026, the Sam Houston Electric Cooperative headquarters facility, located at 1157 E. Church Street, Livingston, TX 77351, is shared by both Transmission Function and Marketing Function Employees. The Transmission Function employees are located in a different corridor than the Marketing Function employees.

Pursuant to 18 C.F.R. § 358.7(e)(1), Sam Houston Electric Cooperative is required to post the name and address of its affiliates that employ or retain Marketing Function Employees.

Pursuant to 18 C.F.R. § 358.7(a), Sam Houston Electric Cooperative is required to post immediately: (1) non-public Transmission Function Information that was disclosed to a Marketing Function Employee in a manner contrary to 18 C.F.R. § 358.6; and (2) notice that non-public Transmission Customer information, critical energy infrastructure information or any other information that FERC, by law, has determined is to be subject to limited dissemination, was disclosed in a manner contrary to 18 C.F.R. § 358.6.

No non-public Transmission Function Information has been disclosed to any Marketing Function Employee in a manner contrary to 18 C.F.R. § 358.6..

Pursuant to 18 C.F.R. § 358.7(e)(3), Sam Houston Electric Cooperative is required to post potential merger partners as affiliates that may employ or retain Marketing Function Employees.

Pursuant to 18 C.F.R. § 358.7(f)(2), Sam Houston Electric Cooperative is required to post any transfer of a Transmission Function Employee to a position as a Marketing Function Employee or any transfer of a Marketing Function Employee to a position as a Transmission Function Employee.

There have been no such transfers within the last 90 days.

Voluntary Consent Provision

Pursuant to 18 C.F.R. § 358.7(c), if a Transmission Customer provides voluntary, written consent, Sam Houston Electric Cooperative may disclose that Transmission Customer's non-public information to Marketing Function Employees and must post: (1) notice of such consent; and (2) a statement that Basin Electric did not provide any preferences, either operational or rate-related, in exchange for that voluntary consent.

No Transmission Customers have provided voluntary, written consent permitting Sam Houston Electric Cooperative to disclose that Transmission Customer's non-public information to Sam Houston Electric Cooperative's Marketing Function Employees. Sam Houston Electric Cooperative has not disclosed any non-public Transmission Customer information to its Marketing Function Employees.

Waivers

Pursuant to 18 C.F.R. § 358.7(h), Sam Houston Electric Cooperative is required to post notice of each waiver of a tariff provision that it grants in favor of an affiliate, unless such waiver has been approved by the Commission.
